Seastack Terms of Service

By approving these Terms of Service ("Terms of Service") or, alternatively, by (i) using the Seastack website (seastack.co), (ii) using any Seastack tool, service, or platform, or (iii) subscribing to any Seastack free or paid subscriptions or plans, the customer ("Customer" or "You") agree to be bound by the Terms of Service of Seastack, Inc. ("Seastack" or "We") set forth herein.

If the Customer enters into this Terms of Service on behalf of a company or other legal entity, it represents that it has the authority to bind such entity and all users who access the Seastack Service through the Customer's account ("Users"). If the Customer does not have such authority, or if it does not agree with the Terms of Service, it must not accept this Terms of Service and shall not use the Seastack Service.

Although we may attempt to notify you via email when major changes are made, you should visit this page periodically to review the terms. Seastack may, in its sole discretion, modify or revise these terms and conditions, Terms of Service, and policies at any time, with or without notice, and you agree to be bound by such modifications or revisions. If you do not accept and abide by this Agreement, you shall not use Seastack Service.


1. Description of Service

Seastack serves as a learning management platform, including but not limited to, the Seastack website, browser extensions, desktop clients, API interfaces, and any feature or service provided by Seastack under free or paid subscriptions (each, a "Service"). You understand and agree that the Service is provided on an AS IS and AS AVAILABLE basis. Seastack disclaims all responsibility and liability for the availability, timeliness, security, or reliability of the Service.

2. Third-Party Products or Services

Our Service may integrate with third-party applications (each, a "Third-Party Product"), including but not limited to internet browsers, payment providers, data analytics applications, and cloud storage providers. THESE ARE NOT OUR SERVICES, SO WE DO NOT WARRANT OR SUPPORT THESE THIRD-PARTY PRODUCTS. We are not responsible for any use, disclosure, modification, or deletion of Customer data transmitted to a Third-Party Product.

3. Use of Service

You must comply with the Terms of Service and ensure all users under your account comply. The Services are not intended for and should not be used by anyone under the age of 13. Customer is responsible for maintaining the confidentiality of Service passwords and accounts.

4. Proper Use

You agree to use the Service in compliance with all applicable local, state, national, and international laws. You shall not:

  • Upload unlawful, defamatory, or fraudulent content.

  • Infringe upon intellectual property rights.

  • Transmit viruses or disabling features.

  • Use the Service for any unauthorized or fraudulent purpose.

5. Content of the Service

You alone are responsible for your content. Seastack takes no responsibility for your or any third-party content. Seastack reserves the right to remove or refuse to distribute any content that violates these Terms.

6. Security

The protection of Customer data is a priority. We maintain administrative, physical, and technical safeguards. However, the Customer bears sole responsibility for adequate security and backup of data when in the Customer’s possession or control.

7. Intellectual Property Rights

  • Your Rights: Seastack does not claim ownership of content you create. You grant Seastack a limited license to access and use your content only as necessary to provide and update the Services.

  • Seastack Rights: You acknowledge that Seastack owns all right, title, and interest in the Service (the "Seastack Rights"). You agree not to copy, modify, or create derivative works from the Service.

8. Copyright (DMCA)

If you believe your copyright has been infringed, please provide notice to support@seastack.co including the specific information required by 17 U.S.C 512(c)(3).

9. Payment Obligations

For paid plans, fees are specified at "check-out" and must be paid in advance. Payment obligations are non-cancelable and fees are non-refundable. Fees are exclusive of any taxes, which are the responsibility of the Customer.

10. Termination

  • For Cause: Either party may terminate if the other materially breaches these terms.

  • Without Cause (Free Plan): Customer may terminate by emailing support@seastack.co.

  • Without Cause (Paid): Paid subscriptions are generally non-cancelable during the term unless otherwise agreed.

  • Inactivity: Seastack reserves the right to terminate free accounts that have been inactive for six (6) months.

11. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL SEASTACK’S AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY CUSTOMER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SEASTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES.

12. Indemnification

Customer will defend and indemnify Seastack against any third-party claims arising from the Customer's use of the Service or violation of these Terms.

13. Publicity

Customer grants Seastack the right to use Customer’s company name and logo as a reference for marketing purposes. To opt-out, please email support@seastack.co.

14. Choice of Law; Jurisdiction

The Terms of Service are governed by the laws of the State of Washington, KING COUNTY, United States. Exclusive jurisdiction for any dispute lies in the courts located in KING COUNTY WASHINGTON STATE
